I. General Terms and Conditions

§ 1 Basic Provisions

  1. The following terms and conditions apply to contracts concluded with us as the provider (AZADA ORGANIC, S.L.) via the website https://azada.es. Unless otherwise agreed, your own terms and conditions shall not apply.

  2. A consumer, within the meaning of these provisions, is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession. An entrepreneur is any natural or legal person, or a legally capable partnership, who enters into a legal transaction as part of their independent professional or commercial activity.


§ 2 Conclusion of the Contract

  1. The subject of the contract is the sale of goods.

  2. By placing the relevant product on our website, we make a binding offer to enter into a contract through the online shopping cart system under the conditions specified in the item description.

  3. The contract is concluded via the online shopping cart system as follows:
    The goods you wish to purchase are placed in the "shopping cart". You can access the "shopping cart" and make changes at any time via the corresponding button in the navigation bar.

    By clicking the "Checkout" or "Proceed to Checkout" button (or a similar label) and entering your personal details, as well as payment and shipping preferences, your order details will be shown as an order summary.

    If you use an instant payment system (such as PayPal (Express/Plus/Checkout), Amazon Pay, Sofort, giropay), you will be redirected either to the order summary page in our online shop or directly to the website of the selected payment provider.

    On the payment provider’s website, you may enter your details or confirm your selections. Finally, your order details will be shown as a final summary either on the payment provider's site or once redirected back to our shop.

    Before submitting the order, you will have the opportunity to check and amend your order details (also using the "back" button in your browser), or to cancel the order. By submitting the order via the relevant button (“order with obligation to pay,” “buy” / “buy now,” “pay” / “pay now,” or similar wording), you are making a legally binding acceptance of our offer, and the contract is thus concluded.

  4. Order processing and all communication related to the contract are partially automated by email. You must therefore ensure that the email address you provide is correct, that receipt of emails is technically possible, and that messages are not blocked by SPAM filters.


§ 3 Special Agreements on Payment Methods

1. Payment via Klarna

In cooperation with Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; “Klarna”), we offer the following payment options. In each case, payment is made to Klarna:

The use of invoice and/or instalment payment and/or direct debit methods requires a positive credit check. For this purpose, we transmit your data to Klarna during the contract initiation and processing in order to verify your address and creditworthiness.

2. Payment via “PayPal” / “PayPal Checkout”

If you select a payment method offered via "PayPal" or "PayPal Checkout," the payment will be processed by PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22–24 Boulevard Royal, L-2449 Luxembourg; "PayPal").

§ 4 Right of Retention, Retention of Title

  1. You may only exercise a right of retention if it relates to claims arising from the same contractual relationship.

  2. The goods remain our property until full payment of the purchase price has been made.


§ 5 Warranty

  1. Statutory liability for defects applies.

  2. As a consumer, you are requested to check the goods immediately upon delivery for completeness, visible defects, and transport damage, and to notify us and the carrier of any complaints as soon as possible. This does not affect your statutory warranty rights.


§ 6 Applicable Law, Place of Fulfilment, Jurisdiction

  1. Spanish law shall apply. For consumers, this choice of law only applies insofar as it does not deprive the consumer of the protection provided by mandatory legal provisions of the country in which they normally reside.
